In light of the recent PRISM scandal I thought that it was worth sharing (with permission) an e-mail that I recently received from someone close to me. We didn't stand up when Congress passed the #patriotact  in the wake of #september11th . SInce then we've seen the creation and expansion of the #dhs , travel restrictions put in place by the #tsa , an indefinite detention clause written into the #ndaa , Congress attempting to pass, #sopa  and #cispa , police in riot gear attacking peaceful protesters at #occupy  rallies. Are we ever going to rise up and say that enough is enough or have we become so desensitized  by everything that has happened that we will simply shrug off this latest threat to our freedom and personal liberties? Do you even really still believe that we are free?
 

Should we worry that the government has everyone's phone records?

Naturally the government currently could care less about most people's communications, and I think most Americans implicitly understand this.  But knowing something as seemingly innocuous as who a person calls and when can have huge ramifications on a small number of individuals whose information needs to be protected.  I'm talking about whistle-blowers, dissidents, campaign organizers, union officials, large investors, lawyers, and politicians, just as a start.  Imagine putting Bush and Cheney back in office for a moment, and imagine what they can do against who they perceive as their political enemies armed with only the knowledge of who they call and when.  Imagine how they would justify this for "the sake of the country".

And all of it perfectly legal under the interpretation of the current administration.  What law prevents someone in the administration from getting a list of phone records of Congress members the day before an important vote?  NONE.  It's not a wiretap, so it's not illegal.  Want to find out if a whistle-blower or activist has been making calls to prostitutes?  Go right ahead. Not illegal.  Sure, they may say that's against POLICY, but we all know violating policy won't get you arrested.  It doesn't fall under the scrutiny of the courts, but you can trust them, right?

The current excuse is that the call records are "only meta-data", and they are not actual voice recordings.  Remember: They only have to go to the FISA court for a voice wiretap.  They pretend as if the information about who calls who and when is information created only recently and thus outside of the bounds of wire-tapping laws, but in fact this information has been available just as long as the telephone has existed.  The only thing that has changed over time is the ease with which a large number of calls can be recorded and searched.  Also, don't the local police have to obtain a warrant to get the phone records of any citizen?  If so, what makes the federal government special?

If this goes unchallenged, it will soon become the norm that the government presumes the right to any form of data that you or I produce, as long as it's not voice data.  That information gives the government great power over individuals, and history has proven time and time again that unchecked power will eventually be abused.

Is your ISP restricting your web access?

In case you aren't familiar with the concept of net neutrality, certain Internet Service Providers, all over the globe, regularly block their customers from accessing websites and services which might compete with the ISP itself. In Europe, for instance, it's estimated that as many as 100 million people may be blocked from using Skype.

Net Neutrality means that the ISP remains neutral with regard to your Internet activity, and allows you to access any and all sites (save for those which are determined harmful).

Interestingly, it's actually Europe that's leading the charge to correct and regulate such issues, while U.S. law lags behind.
