Dear Kate
You can call me Shyam.
In the end I decided not to take legal advice but just to write to you with my honest opinions.
I believe you are deliberately trying to rile me.
How should I know of BoAML's millions of subsidiaries whether Capita is or is not one of them. Do you? Have you checked all 1 million subsidiaries
for this?
I have now sent you all emails relating to this case, so BoAML have no more excuses. I suppose I should not be surprised that there has not even
been an acknowledgment about this.
In my opinion, if you go to the High Court you will spend approximately £10mn per year on costs.
I got some annuity provider quotes for an annuity increaing at 2%pa, roughly the rate of inflation, the capital value of 40 years' of arguments
in court is about £200 mn cost to BoAML. I believe I am bound to win so the total cost of the discrimination case to BoAML is £247.5mn
if it goes to court, excluding the costs and settlement amounts for the class action suit. I will make mince meat of BoAML in court.
Even if you were right, which you are not, that there is an effective time limit on discrimination cases, what you failed to mention,
presumably to discourage me from pursuing the matter, is there is no time limit on class action suits.
So, coming back to the trivial matter of the small courts claim, you could ignore it, lose the papers, fail to be able to tick the right boxes etc
and get a CCJ. In this way BoAML would cease to trade.
Or you could admit liability, and avoid going to court and give me (£12000 or so). You then spend £247.5 mn, plus the costs of the
class action suit (£900,000,000 plus costs with a capitalised value of another £350 mn or so and interest).
Or, you could go to court over £12,000 or so, face the judge and you then go to the High Court and pay £247.5mn, plus the costs etc of the
class action suit with capitalised value of £350mn.
One thing I am considering doing is getting hold of a copy of BoAML latest annual accounts to see whether I have dramatically underestimated
the settlement needed for the class action suit.
Please would you kindly send me a copy of BoAML financial statements and investor communications (to save me having to download it on the internet).
My address is Flat 2, 76 Cotswold Gardens, LONDON NW2 1PG.
I would suggest that you get personal legal advice because I do not think the CEO of BoAML will be happy with you at having riled me.
I suggest that BoAML hire competent lawyers eg a big city law firm, to progress this matter.
I suggest that you pass the papers to someone else as soon as possible.
I suggest that BoAML start preparing a file note for shareholders as to what went wrong and why they are about to follow in the footsteps of Lehman Brothers (another employer who racially discriminated against me and is no more). God is just. How many more people have suffered at the hands of racists at both Lehman and BoAML?
Please let me know whether you have told the regulators about this high probability of BoAML bankruptcy.
Are you keeping the CEO, CFO etc of BoAML up to date with developments?
I suggest that you avoid giving me any more biased advice and instead listen to my kind well intentioned advice to you as set out above.
With kind regards
Yours sincerely
Shyam

Dear Mr Mehta
As I am sure you know, Capita provide pension administration support to BAML, Capita is not part of the BAML Group.
I understand from Amber that Capita has not received a copy of any small claims court pleadings relating to the issues raised below.
If you wish to provide me with a copy of such pleadings prior to formal service by the court I will review (or pass to an appropriate colleague).
Yours sincerely
Kate de Carteret

I have developed a financial model to assist companies in determining the optimal price for their products, a model that has enormous potential for any business seeking to maximize its profitability and value. I have also been studying the equity markets and equity market volatility trends. I have analyzed in-depth trends in age-related unemployment (with surprising implications for equity markets), and in the growing trend of incidence in natural catastrophes.

I have also been refreshing my expertise in the property market: I have in the past advised some of the biggest property companies in the world: Sir Donald Gordon of Liberty International, South Africa and Capital Shopping Centres in the UK (now Intu Properties plc), besides numerous insurance companies.
