The omnibus bill c-38 changed the federal Environmental Assessment Act to exempt almost all projects from requiring any kind of federal environmental assessment.
The federal government once reviewed between 4,000 to 6,000 projects every year. It’s now projected they will only look at between 20 to 30. Environmental assessments were never a perfect tool, but at least they provided an opportunity for experts and the public to get transparent information, make comments and to ensure all serious risks were considered.
 Not only have omnibus bills c-38 and c-45 rushed the regulatory process and made reviews of new energy projects less thorough, but as part of the omnibus bills, new rules have been created that appear intentionally designed to prevent public participation in hearings about new energy projects, such as the Line 9 pipeline project.

BREAKING: HARPER PLANS to turn CBC into state broadcaster : The legislation tabled yesterday effectively eliminates the arms-length relationship with government that's at the heart of public broadcasting .. April 30th 2013 

After C-38, Harper forced CBC to take an oath of allegiance to his government; now like the RCMP; Harper is moving to remove independence of the CBC.

"The CPC government's budget bill contains disturbing changes that introduce direct government interference in the public broadcaster's activities. It is a move that should concern all Canadians.

The new changes would allow the government to directly interfere in the day to day running of the Corporation. 

At the heart is a plan for direct interference in collective bargaining between the CBC and its employees. 

The legislation even goes so far as to place a member of the Treasury Board at the bargaining table. 

CBC's government appointed Board of Directors would now have to seek government approval to reach any agreement with CBC employees.

"This is an outrageous and unnecessary violation of the principle of public broadcasting. It undermines nearly 80 years of public broadcasting in Canada and around the world by meddling with the essential arms-length relationship between the CBC and the government of the day. 

The change is disturbing as it has all the markings of an attempt to turn the CBC into a state broadcaster," said Carmel Smyth, National president of the Canadian Media Guild (CMG), the largest union that represents CBC workers.

Marc-Philippe Laurin, CMG Branch president at CBC, calls the change unprecedented. "This is a dangerous road to go down," he comments. "And make no mistake, this is not about the money. 

The CPC is effectively modifying the Broadcasting Act to inject itself into decisions such as staffing that have a major impact on everything that's done at the CBC."

Smyth noted that besides this aggressive intrusion into public broadcasting, there are other recent examples of this conservative government interfering in the labour relations process such as at Canada Post and Air Canada, and all Canadians should be concerned. 

"We oppose this change vigorously and are looking at all our options," she said.

Enbridge's sketchy pipeline reversal plan affects most Canadians »

It would appear the Federal Conservatives and their oil lobbying chums aren’t only muzzling scientists, they’re putting the ball gag in everyone’s mouth.  When Bill C-38 passed last spring, it essentially gutted whatever substantial environmental laws were left hampering oil production and transportation. But it also quietly created an absolutely undemocratic barrier to anyone wanting to voice their concerns. Enbridge’s recently proposed a reversal to their Line 9 pipeline that converts the pipeline’s capabilities to flow Alberta crude eastward, and passes it through some of the most heavily populated areas of Ontario and Quebec.  It goes by farms, by schools, and over every major river that flows directly into Lake Ontario. It also happens to be the first proposal that will be reviewed by the National Energy Board under Bill C-38’s new regulations. Under these new laws, if anyone who isn’t on the board wants to even comment on the discussions, let alone participate, they must first ‘apply for permission.’

So, concerned citizens will now need to complete a 10-page essay before they will be allowed to participate in National Energy Board public hearings? Uh, that's a tad excessive, isn't it? But don't worry, the NEB assures us these changes are "intended to promote fairness and efficiency by ensuring the board hears from those directly affected."

Bullshit... these changes are intended to make it all the more difficult for concerned citizens to make their voices heard, and all thanks to Bill C-38, last year's first omnibus Budget Implementation Act.

I expect the various questions have a nice, MacCarthy-esque ring to them: "Are you now, or have you ever been, concerned about the environment?"

Today I'm celebrating being married, and I'm really excited about that.

I'm still angry that California voters chose 4 years ago to keep that right from everyone.  Being married has been one of the best things in my life.

On February 16th, 2005, Canadian Prime Minister Paul Martin introduced Bill C-38, the Civil Marriage act, to Parliament.  The text and speech of this can be found at http://vimeo.com/12039668  It's a worthwhile read, because it feels a lot like the question that's going to be in front of the Supreme Court for the Prop 8 challenge.

I hope this is the year the US gets this.  I want all my friends to be able to say that their relationships are as valued, respected, and protected as mine is.
