Ein Unternehmer wollte nicht, dass Google die Anfrage nach seinem Namen um Begriffe wie "Scientology" und "Betrug" ergänzt. Er sagt, er habe nichts mit Scientology zu tun und sei kein Betrüger. Die Noch-Ehefrau des Ex-Bundespräsidenten, Bettina Wulff, hatte in einem ähnlich gelagerten Fall gegen Google geklagt. Sie wollte nicht mehr, dass Googles Suche ihren Namen mit Begriffen wie "Prostituierte" in Verbindung bringt.

Der BGH (Az.: VI ZR 269/12) entschied, dass die Vorschläge von Google das Persönlichkeitsrecht des Klägers verletzen. Google sei für die automatischen Vorschläge verantwortlich, die erscheinen, wenn man einen Suchbegriff eintippt. "Die Googles Algorithmen würden nicht eine objektive Realität widerspiegeln, sie würden wählen aus. Sie werden mit einer bestimmten Vorstellung davon programmiert, was relevant ist, was wichtig sein könnte, welche Faktoren man wie einbezieht." Somit habe Google einen Einfluss darauf, was da in den Treffern erscheint. Das Unternehmen habe mit dem selbst "geschaffenen Computerprogramm das Nutzerverhalten ausgewertet und den Benutzern der Suchmaschine die entsprechenden Vorschläge unterbreitet. Google sei jedoch grundsätzlich erst verantwortlich, wenn der Betreiber Kenntnis von der rechtswidrigen Verletzung des Persönlichkeitsrechts erlangt habe. Dann hat Google in jedem Einzelfall zu prüfen, ob eine Persönlichkeitsrechtsverletzung vorliegt.

Ob Google in dem vom BGH verhandelten Fall zahlen muss, wird das Oberlandesgericht Köln entscheiden müssen.

A dneska má v Německu někdo opačný problém: nechce naopak ve výsledcích na dotaz "scientology" být. Jo, to je pak těžké - vypadá to, že vyhledávače brzo budou výsledky hledání přizpůsobovat hlavně soudním rozhodnutím a ne tomu, co lidé hledají...

London: A German federal court has ordered Google to clean up the auto complete search suggestions that it offers.

The popular search engine automatically suggests search results as per the combination of keywords.

A German businessman, who accused Google of delinking him to scientology and fraud, started the case.

In a report by the BBC, the court does not mean that Google should sanitize its entire index but only remove those defamatory combinations, which may be unlawful or violate one's personal rights.

Google earlier defended itself for having no control over the combinations as they are automatically generated as a result of searches made by other users with the same keywords.

The company's spokesperson said it was 'incomprehensible' to make Google liable for the searches carried out by other users.

Earlier Betina Wulff, wife of former German President Christian Wulff, had filed another case of defamation against Google because the auto-complete linked her to escort services, the reports added.

Hey! Good News : Germany tells Google to tidy up auto-complete

A German federal court has told Google to clean up the auto-complete results its search engine suggests.

The court said Google must ensure terms generated by auto-complete are not offensive or defamatory.

The court case was started by an unnamed German businessman who found that Google.de linked him with "scientology" and "fraud".

Google must now remove defamatory word combinations when told about them, said the court.

A person's privacy would be violated if the associations conjured up by auto-complete were untrue, the federal court said in a statement about the ruling.

However, it added, this did not mean that Google had to sanitise its entire index. "The operator is, as a basic principle, only responsible when it gets notice of the unlawful violation of personal rights," it said.

The ruling on auto-complete overturns two earlier decisions by lower German courts.

In the past, Google has defended itself by arguing that it has no control over the combinations of words that auto-complete suggests. Instead, it said, these were automatically generated by the frequency with which other people were looking for such keywords.

A Google spokesman said he was "disappointed and surprised" by the court's decision, in an interview with Bloomberg. He said it was "incomprehensible" that Google was going to be held liable for the searches carried out by users.

The ruling could also have a bearing on another case involving auto-complete. Bettina Wulff, wife of former German president Christian Wulff, sued Google because auto-complete suggested words linking her to escort services. Mrs Wulff denies ever working as a prostitute and has fought several legal cases over the accusation. The case against Google is due to be heard soon in a Hamburg court.
